SAFE/NMLS Education Requirements

Pre-Licensing Requirements

The Secure and Fair Enforcement for Mortgage Licensing Act of 2008 (SAFE Act) requires that state-licensed mortgage loan originators (MLOs) and Processors complete pre-licensure and annual continuing education. In order to meet pre-licensure continuing education requirements state-licensed MLOs and Processors must complete 20 hours of NMLS approved education which include the following:

   a. 3 hours of Federal law and regulations;
   b. 3 hours of ethics, this shall include instruction on fraud, consumer protection, and fair lending issues;
   c. 2 hours of training related to lending standards for the nontraditional mortgage product marketplace; and
   d. 12 hours of undefined instruction on mortgage origination.

Continuing Education Requirements
   a. 3 hours of Federal law and regulations;
   b. 2 hours of ethics that shall include instruction on fraud, consumer protection, and fair lending issues;
   c. 2 hours of training related to lending standards for the nontraditional mortgage product market; and
   d. 1 hour of undefined instruction on mortgage origination

Important Note:
    1.  Licensees may not repeat the same continuing education course two years in a row.
    2.  The NMLS does not allow continuing education hours to be carried over to the next year

Late Continuing Education Requirements
NMLS has been programmed such that if a Loan Originator/Processor takes a CE course on or before December 31 of a given year, the course credit will only be applied to satisfy the education requirements of that specific year.  Because of this, Loan Originators/Processors who may be seeking to complete their CE requirements during the reinstatement period (Kentucky reinstatement period is from January 1-31st of each year) must take only "LATE CE" NMLS approved courses.  During the reinstatement period, Loan Originators/Processors who had a requirement for but did not complete CE in the previous year will be allowed to take and complete a "Late CE" course which will be retroactively applied to the previous year.
